Pepper spray and f-bombs got a Buffalo cop fired

Published by

Warning: This video contains graphic content. On March 25, 2020, Buffalo police officer Kevin Murphy pepper sprayed and arrested Lakisha Neal. Viewer discretion is advised. The Buffalo police union is asking a judge to overturn an arbitrator’s decision upholding termination of an officer who doused a woman with pepper spray and repeatedly swore at her. It’s rare litigation. Erie County Supreme Court documents dating to 2013 show no other cases of either the city or the police union asking a judge to reverse an arbitrator’s decision on whether an officer should be fired. Lakisha Neal, 42, filed an internal affairs[...]

Who’s responsible for bad cops?

Published by

Common Council Member David Rivera, left, speaks with Buffalo Police Commissioner Joseph Gramaglia. Photo by Bruce Rushton. Mayor Byron Brown has said that he wants the police commissioner to have more power to discipline cops, but change is beyond his purview. An arbitrator now decides discipline, although the city charter says that disciplinary authority rests with the police commissioner. Giving power to the commissioner, according to the mayor, is up to the Common Council. “I don’t control the council, and if there was anything in this document that the council felt they could implement or wanted to implement they would[...]

Minimal discipline for problem Buffalo cop

Published by

In the space of 10 months, Buffalo police officer Davon Ottey cursed, wrongly arrested people, used excessive force, lied about brandishing a knife and sprayed hand sanitizer on a man who used a phone to record police, according to the New York State Attorney General’s office. Ottey’s conduct between June 2019 and April 2020 prompted five citizen complaints and was sufficient to warrant a criminal investigation, the attorney general’s office wrote in a Dec. 28 letter to Police Commissioner Joseph Gramaglia. For its part, the department sustained two complaints against Ottey, issuing a six-day suspension in one case and a[...]

Policing Buffalo’s police

Published by

Buffalo Police Commissioner Joseph Gramaglia and Mayor Byron Brown testified last fall that the city’s contract with its police union and the power it bestows on an arbitrator make it too difficult to discipline cops accused of misconduct. “I think any chief executive that’s running the department would like to have the managerial ability to run a department, but that’s not the contractual language that was laid out well before my time,” Gramaglia testified during a recent deposition in a police brutality lawsuit. “The arbitrator’s decision, the independent arbitrator’s decision and finding, is final in a disciplinary matter.” Gramaglia and[...]

Almost fired, then promoted

Published by

A Buffalo police officer once charged with assault, tagged for termination and barred from the witness stand has been promoted to detective and is again allowed to testify. “Irremediable problems of credibility” prompted a ban on Joseph Hassett taking the stand, District Attorney John Flynn wrote in a 2019 letter to police. The department then put Hassett on desk duty and sought termination. After an arbitrator overruled the department in 2020, Hassett returned to street duty. He’s now a detective. “Oh my god,” attorney Richard Weisbeck responded during a recent deposition when Police Commissioner Joseph Gramaglia revealed that Hassett had[...]

License plate readers target minority neighborhoods

Published by

Buffalo police have quietly installed license plate readers at 41 intersections in the city, two-thirds of them located in neighborhoods populated predominantly with people of color.  Buffalo police, in response to a Freedom of Information Law request for the department’s policies on license plate readers, wrote that they’re used for “law enforcement investigative purposes only.” While it’s unclear how the department now is using readers, police in the past used mobile readers to issue traffic tickets, at considerable profit to the city.  Unlike many other cities, neither the police nor Mayor Byron Brown, their commander in chief, have made the[...]

Another claim of misconduct by Buffalo police

Published by

After spending a month in the hospital, a Black Rock man shot by Buffalo police filed a notice of claim against the city Monday, typically precursor to a lawsuit. Jon Battison, 36, was holding a pellet rifle to his own chin in the attic of his home on Tonawanda Street when Officer Kereem Johnson pulled the trigger eight times. One round found the mark, striking Battison near the shoulder.  Police went to the home on Sept. 23 because Battison was reportedly suicidal and had ingested pills. “Suicide by cop,” Battison told police as he lay wounded in the attic of[...]

City to pay $255k to victims of police raid

Published by

The city of Buffalo is poised to pay more than a quarter-million dollars to a family whose Parkside home was raided by a police SWAT team hunting for crack cocaine.  Officers armed with guns and a no-knock search warrant found no drugs at the home of Maisha Drayton, then a senior director of staff development at the Evergreen Association, a nonprofit health care organization. Neither she nor her two children nor her husband, Trevor, who wasn’t home when police broke through the door shortly after 6:30 a.m. on Dec. 11, 2014, had any criminal history.  The city law department last[...]
