Judge throws out counts in fatal police shooting lawsuit

A federal judge has dismissed several counts against the Buffalo Police Department and two officers involved in the 2017 fatal shooting of Jose Hernandez-Rossy.  Left intact in a lawsuit filed by Margarita Rossy, the dead man’s mother, are claims that police improperly used lethal force after violating Hernandez-Rossy’s rights against unreasonable search and seizure when they pulled him over on suspicion of smoking marijuana while driving.  Otherwise, U.S. District Court Judge William Skretny on Sept. 5 threw out claims that police targeted Hernandez-Rossy, 26, based on race and that the disciplinary history of Officer Justin Tedesco, who pulled the trigger,[...]

Kelly discusses police contract on WBFO

In July, Buffalo’s police union won a big victory in its three-year-old (and counting) negotiations with Mayor Byron Brown’s administration for a new contract. A state arbitration panel granted police — whose contract expired in 2019 — raises and back pay worth as much as $15 million. The city got nothing in return: none of the reforms protestors and elected officials clamored for in the summer of 2020, no new managerial rights, not even a reinstatement of a residency requirement that expired with the old contract. Police assault injures protester

Updated: Friday, 3:40 a.m. Important events have unfolded since we posted Thursday evening about a peaceful resolution between police and protesters the night before in front of City Hall. Shortly after 8 p.m. Thursday, a video shot by a reporter with WBFO captured two Buffalo police officers shoving a 75-year-old protester to the ground. The man struck his head with an audible thud on the sidewalk in front of City Hall and immediately began bleeding. No prosecution in deadly police shooting

Editor’s note: The clip above shows the key minute of the encounter between police and Rafael Rivera. A second clip below expands on that video. In an announcement Monday, Erie County District Attorney John Flynn said the Buffalo police officer who fatally shot Rafael “Pito” Rivera in September did nothing wrong and will not be prosecuted.
