Suit seeks to halt Battaglia Demolition

Published by

Attorney General Eric T. Schneiderman will ask a judge to halt the operations of a South Buffalo construction and demolition debris facility that’s been the subject of a longtime dispute with neighbors, the city and state environmental regulators. The Attorney General’s Office said in a statement Tuesday night that the lawsuit, expected to be filed Wednesday in Erie County Supreme Court, charges that the dust, noise, odors, vermin and truck traffic at Battaglia Demolition off Peabody and Seneca streets “have created a public nuisance under New York State law, and that the facility is illegally operating without required state environmental[...]

Lawmakers balk at Poloncarz’s lead proposal

Published by

The Erie County Legislature passed on another opportunity Thursday to approve the county executive’s $3.75 million lead prevention plan that includes eight new employees to inspect homes and help families that have children with elevated blood lead levels. Buffalo Mayor Byron Brown’s 11-point lead hazard control plan released Wednesday was not enough to persuade county legislators to move forward with a separate action plan proposed by County Executive Mark Poloncarz. The city’s commissioner and assistant director of permits and inspection services told county legislators Thursday afternoon that the city plan focuses on education, collaboration with the county health department and[...]

Buffalo Billion probe targets Cuomo insiders

Published by

U.S. Attorney Preet Bharara’s investigation into the Buffalo Billion, triggered by Investigative Post’s relentless reporting, appears to have targeted members of Gov. Andrew Cuomo’s inner-circle. The feds issued subpoenas to the governor’s office Friday, and, in turn, the Cuomo administration announced its own investigation and issued a press release that appeared to throw one or more close associates under the bus. Folks, this could get real ugly real quick. Those under scrutiny include Joseph Percoco, a top Cuomo aid and political enforcer who recently left the administration; longtime associate and lobbyist Todd Howe; and Alain Kaloyeros, the so-called nanotech guru who the[...]

Council ignores warning on lead test kits

Published by

The Common Council’s chief response to the city’s lead poisoning problem involves a commitment to distribute lead test kits to residents that one expert has termed a “very dangerous idea” with the potential for “extremely hazardous” results. No fewer than three experts challenged the wisdom of the Council’s plan in interviews with Investigative Post, including one who shared her concerns in writing last month with the office of Masten Council Member Ulysees Wingo. Those warnings have not been shared with other members, even when the test kits were discussed during Tuesday’s Council meeting. “Overall, I think there is a strong national[...]

Urban League sues over critical audit

Published by

The Buffalo Urban League, disgruntled after a critical audit by the Erie County Comptroller, is pressing ahead with legal action against the county. The agency filed an Article 78 petition Friday in State Supreme Court. A court date is set for May 10. Urban League President Brenda McDuffie said the comptroller’s report was “filled with factual and procedural errors” and that had harmed the agency’s reputation. The Urban League is not seeking monetary damages but wants the report to be withdrawn. Erie County Comptroller Stefan Mychajliw said he stands by the work of his auditors. He said the Urban League was wasting money on legal[...]

Urban League still complaining about audit

Published by

The   The Buffalo Urban League, recently the subject of a critical report from the Erie County Comptroller, is threatening legal action unless the report and negative public statements are withdrawn, Channel 2’s Dave McKinley reports. The story includes comments from Charlotte Keith of Investigative Post. The audit confirmed previous reporting by Investigative Post that found the Urban League submitted falsified bills, failed to properly train employees or secure confidential records, and retaliated against whistleblowers. Sources have told Investigative Post that the audit findings are being reviewed by Acting Erie County District Attorney Michael Flaherty to determine if there are possible[...]

US Labor Secretary: inclusive growth matters

Published by

U.S. Secretary of Labor Thomas Perez, a Buffalo native, received a standing ovation in his hometown Tuesday as he spoke about the importance of workforce development at Bennett High School. Perez stressed the importance of hiring local residents for taxpayer-funded construction projects. “We can make sure that the residents of Buffalo and Erie County participate in our prosperity. Inclusive growth is what we’re all about,” he said. Perez’s visit comes amid growing concern that communities of color aren’t being included in the opportunities created by the city’s construction boom. The local construction trades, whose members staff many major public works projects, have made[...]

State money for lead won’t go far

Published by

State Attorney General Eric Schneiderman announced over the weekend that his office is “investing” $346,825 in the Buffalo Green and Healthy Homes Initiative. This is the attorney general’s first financial commitment earmarked for lead programs in Buffalo since the initiative launched in 2009. About 40 low-income, owner-occupied homes will benefit from the attorney general’s funding. That’s in addition to the 882 homes already made lead-safe since the program’s inception. While those numbers represent a degree of progress, consider there are 85,000 housing units in Buffalo at risk for lead hazards. In other words, about 1 percent of the homes were[...]
